Interpretation:

In these Terms and Conditions, “I”,“we”, “coach”, and “trainer” refer to Gillian Powell/New Leaf Fitness and Wellbeing

Booking and Payment:

Booking of a class, course or PT consultation is to be completed online. Payment is also completed online, through my online payment partner, Paypal.

Classes must be booked through my online system allowing sufficient time for me to thoroughly evaluate your screening form and for you to obtain medical clearance when requested, and require a minimum number of participants to go ahead.

In cases where the minimum number is not fulfilled for a class to go ahead, you will receive a full refund.

If for any reason discovered in the screening process it is deemed that the offering is not suited to you, you will receive a full refund.

Fees are calculated for the full term or a stated period of time and payment is due prior to starting the screening process. You spot is not reserved unless you have fully registered (payment and online screening). Fees are to be paid on time. If you join a class part way through a term or period of time (where appropriate), fees will be prorated based on the number of weeks remaining in the term or period of time, and are due in full prior to your first class. There are no exceptions. I do not offer pay-as-you-go or one-off classes, ever. I could not possibly serve you properly if I did.

Please note that your class/session payment may be forfeited if you are deemed unfit to attend any class/session as a result of having deliberately provided incorrect or misleading information in your Screening Form replies, or if you refuse to obtain medical consent when requested to ensure you are medically and physically fit to participate.

Refunds are not available for change of mind or change of circumstances. Transfer of your spot in class to another person is not possible.

I reserve the right to exercise my discretion in exceptional circumstances, however you may not be refunded monies paid in advance in respect of PT sessions you have booked but fail to attend if less than 24 hours’ notice is given, save for in the event of illness or injury preventing you from participating in any fitness activities, supported by medical evidence. In such cases your account will be credited with a make-up session on receipt of the appropriate medical evidence. Nothing in this clause shall preclude you from obtaining a refund if I am in serious default of my obligations to you. Your PT make-up session must take place within 2 weeks of the missed session and not take the place of a regularly scheduled session.

1 Cancellation of a PT session or notice of missing a class must be done 24 hours prior by messaging me directly.

There are no refunds for missed classes as we are reserving a spot for you in class. You may make up a class session in another time slot for general classes where multiple times are offered, provided there is a spot in class available for when you would like to attend. If not, your missed class is forfeit. The missed class must be made up within the same term or time period of a class.

A PT session can be cancelled with greater than 24 hours notice, and must be made up within 2 weeks of the missed session. It must not take the place of a regularly scheduled session. If not made up in this time period, your session is forfeit.

All PT Subscriptions of New Leaf Fitness and Wellbeing are strictly payable per four week time period and are not transferrable.

PT Subscriptions can only be placed on hold in the event of illness or injury preventing you from participating, supported by documentary evidence from your doctor, and this will therefore extend the terms by the length of time placed on hold. It is possible in many cases of injury to modify exercises or other parts of a program so that you can continue during this time period. To determine this, I will speak with your health care professional (with your consent).

At the end of your contracted period you are required to inform New Leaf with greater than 7 business working days notice of the end of the four-weekly period of any changes to New Leaf PT Subscriptions, and no changes can be made after this date until the following month. We accept no responsibility if you fail to inform us and you will be required to fulfil terms of the Subscription.

Please remember that this is not a “hobby” for me. I am running a business with expenses and providing a service that needs to be paid for on time. I work very hard to plan classes ahead of time and provide exceptional offerings.

Your invoice will also act as your receipt of payment.

Fees will not be increased during a term but may be increased after that. I will not use this right to vary the terms of any special offer which applies to you.

New Leaf reserves the right to make adaptions to the timetable at any time, and all classes or other sessions are subject to change at any time. This is to allow but not limited to extreme weather conditions, local area situations, participation numbers, students particular requirements and the like. It is your responsibility to keep your contact information up to date so you can be informed in the unlikely event that such a situation arises!

If a class or course is cancelled by New Leaf your class/sessions or courses will be rearranged. Where this is not possible, any monies will be refunded. We will endeavour to provide as much notice as possible should a class, course or session need to be rescheduled.

Discounts:

Family Members: If there are 3 or more members of the same family household (parents and their dependent children) signed up during a term, a 10% discount will be applied to their fees.

Safety first!

The health and safety of members is important to me. This clause sets out some of the things I require of you to help achieve that objective.

Your physical condition
A safe and effective exercise program is dependent upon accurate health and fitness profiling. It is therefore essential that you tell me in writing all relevant personal health and fitness information both before (through our pre-exercise questionnaire or otherwise) and during the course of any exercise program or other activity.

Fitness sessions have been designed for participants who appear to be healthy, or are attending a specialty course for a particular set of circumstances, and appropriate modifications can be made for many physical issues. In order for such modifications to be made, I require full disclosure of physical ailments. It is up to my discretion, following analysis of participant screening forms, as to whether I need to be in direct contact with your doctor or other allied health professionals (including but not limited to physiotherapists, osteopaths, chiropractors, dieticians, GPs, specialty doctors). I will then request your written consent. This is considered best practice and is part of my high standard of service.

You promise that information you disclose to me will be true and accurate and not misleading in any way. You must not attend and use the facilities and services whilst you are suffering from any illness, disease, injury or other condition that could present a risk to the health or safety of other members and guests or yourself.

If you happen to use the facilities and services before disclosing relevant health information to me, you promise that you are in good physical condition and you do not know of any reason why you may not be able to exercise safely.

Please stop and notify the Instructor if at any point during the session you feel pain or discomfort.

Proper use of equipment/following instructions
I will provide you with instructions before using the facilities and services, which you must understand before use. All activities will be explained and demonstrated. If you feel you have not understood any instruction you must notify the Instructor so that activities can be further explained and demonstrated until fully clear. In any case, you promise to take care when using the facilities and services and make sure that you use the facilities and services including equipment appropriately and safely. If you are ever not sure how to use or operate any equipment properly, or how to perform an exercise, please ask me before you proceed.

I can refuse you entry to the facilities and services if you behave in a way that is seriously risky or inappropriate, such as failure to listen to or comply with the instructions and safety guidelines given, if you threaten, belittle or harass others, deliberately or recklessly damage equipment or facilities or if you use or distribute illegal or performance enhancing drugs, or are under the influence of alcohol or drugs.

Please follow my directions. You agree to follow any reasonable direction relating to health and safety or any other matter.

I take your privacy seriously:

When you return your forms I will have access to personal information about you, such as information relating to your health. I will never give your personal information to a third party other than with your permission. Please see my privacy policy for more information.

Please keep your contact details up to date:

You promise to tell me promptly if you change your address, phone number, email, payment information or if there is a change to any other personal information relevant to your membership with me. This includes any matters that affect the health or safety of you or others.

Your responsibility for damage:

You agree to pay for any damage to the facilities, including equipment, caused by you, your children or your guests through a wilful act or negligence.

Nothing in these Terms & Conditions shall affect your statutory rights.
